Publisher's Note

Welcome to the first issue of California Deathcare Weekly.

California’s funeral, cemetery, crematory, hospice and allied professionals work in a field where regulation, technology, consumer expectations and business conditions can change quickly. This publication is intended to provide a concise, useful Wednesday briefing: what changed, what deserves attention and what may affect your operation.

Our editorial goal is straightforward. We will link readers to original sources, distinguish independently verified information from submitted announcements, correct errors openly and keep paid or house promotional material clearly labeled. We will also make room for California market data, education, professional milestones and the history of funeral service—without allowing advertising to overwhelm the editorial content.

I welcome your news, events, appointments, acquisitions, regulatory questions and corrections.

AB 2542 Would Change Who May Control Disposition in Certain Abuse-Related Cases

California funeral establishments and cemeteries should watch AB 2542, “Marissa’s Law,” as the 2025–26 legislative session closes.

The enrolled bill would amend Health and Safety Code section 7100. When a funeral director or cemetery authority knows that the person otherwise holding the right of disposition was subject to a domestic-violence restraining order protecting the decedent at the time of death, the right would pass to the next eligible person in the statutory order of priority. The same would occur when a court determination or other legally determinative document specified by the bill shows that giving the person control would have been contrary to the decedent’s best interests.

The bill also states that a funeral director or cemetery authority would not face civil or criminal liability, or licensing discipline, for a determination made under the new provisions.

AB 2542 passed the Senate on August 19 and the Assembly on August 31. It was enrolled September 4 and presented to the Governor at 3 p.m. on September 15. Status checked September 30, 2026: The official legislative history available at this check still lists September 15 as its latest action, when the bill was presented to the Governor. No signature or veto is recorded in that history. CDW is not reporting the measure as enacted law.

Operational takeaway: If the measure is signed, firms should update disposition-right checklists, train arrangement staff to recognize qualifying orders and documents, and establish a consistent escalation and documentation process. The final chaptered text and effective date should be reviewed before changing procedures.

CFB Posts Revised Consumer Guide

The California Cemetery and Funeral Bureau has posted its revised Consumer Guide to Funeral and Cemetery Purchases. The guide explains who controls disposition, available disposition choices, what consumers should expect from funeral and cemetery providers, advance planning, pricing and complaint resources.

For funeral establishments and cemeteries, the guide is worth reviewing as both a consumer-education document and a staff-training reference. Firms should make sure their own explanations, website language and arrangement-room materials remain consistent with current California requirements and the Bureau’s terminology.

Natural Organic Reduction Regulation Is Approaching Its 2027 Start

California law calls for the Cemetery and Funeral Bureau to begin licensing and regulating natural organic reduction facilities and managers on January 1, 2027. In its May regulatory update, the Bureau said staff had prepared the regulatory package for departmental review before submission to the Office of Administrative Law and a 45-day public-comment period.

Operators considering this form of disposition should monitor the Bureau’s proposed-regulations page rather than assume that draft requirements are final.

Orange County Highlights Changes to Cause-of-Death Review Guidance

Local registrar notice supplied by the publisher. On August 28, the Orange County Office of Vital Records circulated a short list of changes drawn from CDPH’s longer cause-of-death review guidance. The notice says pneumonia and aspiration pneumonia require an underlying condition regardless of age; chronic renal or kidney disease and senile degeneration of the brain require an underlying cause; and urinary tract infection or urosepsis requires an underlying condition regardless of age. For cirrhosis, staff should ask for its type and, if it is non-alcoholic, an underlying condition.

Arrangement and filing teams should anticipate follow-up with certifying physicians when these terms appear without the requested detail. The physician remains responsible for the medical certification.

This is a summary of selected items, not the complete CDPH list. A public link to the current EDRS handbook guidance has not been verified.

Johnson Consulting Group Announces Planned Leadership Transition

Submitted company announcement. Johnson Consulting Group says Chief Operations Officer Jeff Casey will step away from that position on October 1 and retire from full-time work at the end of 2026. Kristen Szymborski, CPA, will assume the newly created role of Chief Financial & Operations Officer on October 1. Casey will remain a full-time consulting resource through December 31 and continue with the firm in a consulting capacity after year-end.

The transition has a California connection: Casey is a California-licensed funeral director and embalmer, is a Cypress College of Mortuary Science graduate, and previously held leadership responsibility for funeral homes and cemeteries in greater Los Angeles and Ventura County.

California Cremation Share: August 2026

Funeral Convergence’s August 2026 California report records 21,980 deaths and 15,222 cremations, an implied 69.3% cremation share for the month. It separately records 16 alkaline hydrolysis cases; those cases are not included in the cremation numerator above.

The underlying occurrence-data export is dated September 13, 2026. The report also notes that 438 cases could not be matched to a current funeral-establishment roster entry; that limitation affects county licensed-firm market-share tables, not the statewide totals shown here. Later data extracts may revise the August numbers.

2026 Marks 150 Years Since the First Modern Cremation in North America

The Cremation Association of North America identifies 2026 as the 150th anniversary of the first modern cremation in North America. The milestone offers an opportunity to look beyond the growth of cremation itself and examine how the profession’s responsibilities have expanded: consumer education, identification and chain of custody, authorization, permanent memorialization and the long-term handling of unclaimed remains.

This week’s historical feature is based on a publicly available association history; no Mortuary Management or Funeral Monitor article has been reproduced. Archive material from those publications will remain out of CDW until ownership and republication rights are confirmed.

Legacywyse Offers a Free Estate-Settlement Workspace

Submitted vendor information; CDW has not independently tested the product. Legacywyse describes its platform as an organizational workspace for first-time executors, with task lists, estate-inventory tools, a family-review process and document-drafting assistance for supported matters. The free plan may be of interest to funeral homes building aftercare resource lists.

California firms should review the product before recommending it and avoid implying that it provides California legal advice or California probate forms. The vendor says its current form support includes all 254 Texas counties and states that the service provides general information and drafts, not legal advice.
